Consultational and arbitrational functions

Point 3 of Article 3 of Law 6/2004 establishes the following consultational and arbitrational functions for the GCC:

  • To issue a preceptive report on those government bills that modify or abolish Law 6/2004 and those draft regulatory norms that develop it.
  • To issue a non-binding report on the opening of large commercial establishments within the territory of the Autonomous Community of Galicia.
  • To draw up the preceptive report required by the Service for the Defence of Competitions or the Competition Court of the General State Administration with regard to those types of conduct that, affecting a supra-autonomic setting or the entire Spanish market, may have a significant bearing on the territory of Galicia.
  • To draw up those reports envisaged in Article 13 of the LDC on any possible compensation for loss and damages that may result from those types of conduct envisaged in Articles 1, 6 and 7 of the LDC, within its territorial setting and at the request of the competent legal bodies.
  • To carry out those arbitrational functions bestowed upon it by the Law.
  • To draw up an annual report.
  • To draw up an annual report on the situation of competition in Galicia.

Besides the aforementioned reports, the GCC has certain additional jurisdiction over two matters that are highly relevant: mergers and acquisitions on the one hand, and integration and government aid on the other.
