The functions of the Galician Competition Court (GCC) are laid out in Article 3 of Law 6/2004, which are complemented by those appearing in Article 1 of Decree 20/2005 (3 February), developed from Law 6/2004. In accordance these two regulations, the functions of the GCC can be divided into three broad groups:
The fundamental function of the GCC is to resolve those disciplinary procedures affecting any types of conduct that are detrimental to competition, and which are contemplated in Articles 1, 6 and 7 of the Law for the Defence of Competition: in this regard, there are three types of prohibited conduct or practices.
Law 6/2004 (12 July), regulating the bodies for the defence of Competition in the Autonomous Community of Galicia, assigns the various consultational and arbitrational functions to the GCC.
As stipulated in Article 1 of Decree 20/2005(3 February), pertaining to Law 6/2004, the GCC shall have to the power to instigate the carrying out of studies into the matter of competition that it may see fit, as well as to carry out all those activities that may be necessary to disseminate the benefits to society of free competition.
